The selected users and organizations participating in the Edudaris® understand and agree to the general principles outlined in the Privacy Policy, Terms of Use, and User Statement of Rights & Responsibilities. They also understand and agree that while the aforementioned guidelines are fully applicable, some specific features outlined below are currently being developed during the Beta testing phase and may not be fully functional or available for all or part of the duration of the Beta testing phase. Nonetheless, both the intrinsic design of the site and ongoing maintenance assure that user privacy, safety, and security of personal information is safeguarded and held as the highest priority by company staff at all times.

1. Introduction

a. Our highest priority is maintaining the integrity and privacy of your information in order to establish a relationship of trust and confidence with each and every site member. We hold your right to keep your information confidential of utmost importance. By reading the following guidelines of our privacy policy, you will have a better understanding of what we do with the information you provide us and how we work to maintain its privacy and security. We appreciate your placing your trust in Outreach Youth Empowerment, L.L.C. ("OYE"), the provider of the Learning Management System, Edudaris® and the Path to Scholarships® College, Career, and Scholarship Planning e-Courses and e-Portfolio.

b. The fundamental principles of our privacy policy are:
i. Data will be processed fairly and in accordance with all applicable laws.
ii. Data collected is solely for specified and legitimate purposes and will not be further processed in any way that is incompatible with the fully disclosed purposes.
iii. All data collected will be maintained securely, in accordance with industry standards and best practices in order to maintain the security and the protection of data.
iv. Data will never be shared with a third party without the full consent of the owner of the data unless so required in support of the school, or to complete a transaction on behalf of the owner of the data such as a payment transaction, or is required by law, warrant, subpoena or similar legal process.
v. We hold the right to modify the Privacy Policy, when and if deemed necessary. Users will be notified of any changes or modifications to the revised Privacy Policy located on the site. Unless stated otherwise, our current privacy policy applies to all information that we have about you and your account. If we make changes to this Privacy Policy, we will notify you by publication on this page. Should material changes be made, we will provide you additional, prominent notice as appropriate under the circumstances.
vi. If Edudaris® changes this Privacy Policy, changes will be posted on the website so that you will always know what information is gathered, how that information might be used, and whether we will disclose it to any entity.
vii. By use of the site, you signify your full agreement to the Edudaris® Privacy Policy. Continued use of the site following the posting of any changes to the privacy terms will mean you accept those changes. We reserve the right to modify this policy at any time; please review the Privacy Policy on a frequent basis. Should material changes be made to this policy, we will notify you either by email, by broadcast through our software interfaces, or by means of a notice.

d. Security. All personal, classified, and confidential information is stored on servers at a location designed specifically to ensure that no unauthorized individuals have access to the server or its data.

e. Scope: This Privacy Policy covers all of Edudaris®. It does not, however, apply to entities that Edudaris® does not own or control, such as applications and websites using Edudaris®. By using or accessing Edudaris®, you agree to our privacy practices outlined.

f. Report Violations. You should report any security violations to us.

g. No information from children under age 13. If you are under age 13, please do not attempt to register or participate on Edudaris® or provide any personal information about yourself to us or any other entities related to the site. Should we learn that we have collected personal information from a child under age 13, that information and the user account will promptly be deleted. If you believe that we may have obtained any information from a child under age 13, please contact us immediately.

h. Parental participation. All minors 13 years of age or older must obtain full parental permission prior to registering on Edudaris®, sending information about themselves to anyone over the Internet; we encourage parents to instruct their children regarding safe internet use guidelines. Also all minors 13 years of age or older must enter a parental email address when registering so that if any user contacts or send information to minors 13 years of age or older, a notification is sent to that parent’s email address. However, this feature does not give the specified parent access to his/her child’s profile or any other account information on Edudaris®.

2. Information we receive and you provide to us:

a. Information you provide regarding yourself. When you sign up for Edudaris® you provide us with your name, email address, gender, birth date, educational institution, educational status, city and state. During the registration process we give you the opportunity to connect with your friends, classmates, schools, educators, etc. You will also be able to add a picture of yourself. Periodically, we may ask for additional information for security reasons or to provide specific services to you. After initial registration, you may provide additional information about yourself by connecting with, for example, your current city, hometown, educational institution, networks, activities, interests, and places. Additionally, you may provide personal information about yourself, such as your political and religious views.

b. Content. One of the primary reasons people use Edudaris® is to connect, communicate, network, and share content with others in a professional, academic environment. Examples include when you share your thoughts, upload or take a photo, upload or record a video, share a link, create a group, make a comment, write something on someone’s wall, or send someone a message. If you do not wish us to store metadata associated with content you share on Edudaris® (such as photos), please remove the metadata prior to uploading the content.

c. Connection with an Educator through the e-Course Creation and e-Management Feature. Should you, as a student, join a class group created by an educator through any educational institution, only the educator in charge of the class group and any upper level administrator(s) from your educational institution will have access to information you provide in the scope of the course. This includes, assignments, quizzes, tests, and any other information you submit while enrolled in the course. Once you leave the class group on Edudaris®, no one will be able to view this information.

d. Edudaris respects all applicable national and international children's privacy regulations. Edudaris® complies with the Family Educational Rights and Privacy Act (FERPA) (20 USC §1232g, 34 CFR Part 99), a federal U.S. law protecting the privacy of student educational and academic records. Edudaris® does not collect personal information from minors under the age of 13, and any information retained which pertains to students will not be shared with anyone outside of our company, subject to the limitations described in this statement.

e. It is the responsibility of our client educational organizations to utilize our services (e.g. the collection of information from students by means of web forms) in a manner that complies with FERPA and similar regulations unique to the jurisdiction within which our client educational institutions operate.

f. To respond to legal requests and prevent harm. Information may be disclosed in accordance to subpoenas, court orders, or other requests (including criminal and civil matters) if we have a good faith belief that the response is necessarily required by applicable laws. Information may also be shared under a good faith belief when it is deemed necessary to prevent fraud or other illegal activity, to prevent imminent bodily harm, or to protect ourselves and you from individuals who would violate our Statement of Rights and Responsibilities and Terms of Use. This may include the sharing of information with other companies, institutions, qualified legal counsel, courts or other government entities.

g. Transfer in the Event of Sale or Change of Control. In the event that ownership of all or a material part of our business changes, we may then transfer your information to the new owner so that the service can continue to operate without interruption. In such an event, your information would remain subject to the guidelines and promises made in our pre-existing Privacy Policy.

3. Sharing Information:

Edudaris® contains public posting, forums, groups, and one-to-one communication forums permitting direct communications with other users. Any information provided by you in these posts is deemed to be information available to public viewing, not subject to any disclosure restrictions or representations. We are not responsible for any information posted and/or viewed in such portions of our website.

Edudaris® reserves the right to remove any content from any public access viewing areas at any time and without notice. By posting any content in a public access viewing area, you automatically agree to indemnify Outreach Youth Empowerment, LLC, Edudaris® and its affiliates, members, officers, employees and agents, from and against any and all third party claims, demands, liabilities, costs or expenses, including reasonable attorneys' fees, resulting from your breach of these posting restrictions. By posting in a public access viewing area any content authored or owned by you, you automatically (a) grant to all other public access area participants, and any other person or entity affiliated with the public access area, a perpetual, royalty-free, irrevocable and unrestricted worldwide right and license to use, reproduce, and distribute the posted content for the limited purposes of discussion and commentary, (b) grant to Outreach Youth Empowerment, LLC, Edudaris® and its affiliates a perpetual, royalty-free, irrevocable and unrestricted worldwide right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from and distribute the posted content or incorporate the posted content into any form, medium, or technology now known or later developed, for any purposes deemed appropriate by Outreach Youth Empowerment, LLC and Edudaris®.

Edudaris® will not knowingly sell, share, rent or otherwise transfer your information other than in accordance with the terms set forth in this Privacy Policy.

Privacy Policy and Sharing Information with Sponsors
Colleges/Universities, Vocational/Technical Schools, and/or Business/Organizations to apply for offers is your decision made at your own risk. If you choose to share your personal, profile information and any other information about yourself to third parties, including Colleges/Universities, Vocational/Technical Schools, and/or Business/Organizations Sponsors, and/or sponsors who have products, services and opportunities which may be useful to you, you do so at your own risk and accept the responsibility of the risk. Outreach Youth Empowerment, LLC and Edudaris® makes no guarantees or are responsible, if the information or offer is true or accurate, the quality, safety, or legality of the offers, the accuracy of the offerings, and/or the intent or ability of the sponsors to offer an opportunity.

Certain actions on the site, including, but not limited to adding an offer to your My Offers list, asking a sponsor a question and indicating you are planning to apply to an offer, may also result in your information being shared. Because Outreach Youth Empowerment, LLC and Edudaris® understands how important your information is to you, we do not share any information that can identify you without your permission. If you give your permission to allow third parties to contact you, receive personal information about you (such as your contact information and other information collected during your visit to Edudaris®) this information may be shared with other users, sponsors, colleges/universities, vocational/technical schools, and/or business/organizations. Regardless of your decision regarding the sharing of your personal information, we reserve the right to share aggregate demographic data and related usage information with our sponsor partners: universities/colleges, vocational/technical schools, and/or business/organizations. Such aggregate information will not contain any personal information, which can identify any individual user.

4. NO WARRANTIES

Edudaris® under Outreach Youth Empowerment, LLC is a venue for students to first prepare for their future using the Path to Scholarships® Free College and Scholarships Planning e-course and then be matched to offers that will provide opportunities for the students. Outreach Youth Empowerment, LLC and Edudaris® are not involved in the actual selection of students for scholarships or the admission process between colleges, universities and students, or any transactions with advertisers appearing on the Web Site or in newsletters. As a result, Outreach Youth Empowerment, LLC and Edudaris® have no control over the quality, safety or legality of the offers, the truth or accuracy of the listings, the intent or ability of colleges and universities to offer admission. Outreach Youth Empowerment, LLC and Edudaris® are in no way responsible for the ability of colleges to provide a quality education. Outreach Youth Empowerment, LLC and Edudaris® are not responsible for the information or recommendations appearing on any forum associated with any Edudaris® site.

If you choose to interact with others on Edudaris®, including but not limited to inviting parents, guidance counselors or fellow students to share your profile information, be advised that while Outreach Youth Empowerment, LLC and Edudaris®, may choose to take steps that it believes in its sole discretion are reasonable in order to determine that the invited person is in fact the person he/she represents him/herself to be, you assume all risks associated with dealing with other users with whom you come in contact through the Edudaris® and/or the other Edudaris® sites and agree to hold Outreach Youth Empowerment, LLC and Edudaris®, harmless from any and all claims that may arise from such interactions.

Edudaris®, may contain inaccuracies or typographical errors. Outreach Youth Empowerment, LLC, and Edudaris®, makes no representations about the accuracy, reliability or completeness, of any Edudaris®, site or the web site content or the timeliness of any services therein provided. The use of the Edudaris®, sites and the web site content is at your own risk. Changes are periodically made to the Edudaris®, sites. While we will endeavor to make these changes at a time least likely to interfere with your use of the web site, such changes may be made at any time.

No representation or warranties are given that the user will obtain financial assistance or be admitted to the college/university/school of their choice. Any advice, methods, recommendations, and tools given verbally, through the videos, and assignments on the Path to Scholarships® courses are solely the opinion of the authors and should not be interpreted as exhaustive.  

Disclaimer:  Our listing of scholarships is not exhaustive. We encourage students to also look for scholarships at their high school, colleges, community, churches, clubs, scholarship books, Internet search engines, and other scholarship websites.  We never promise that a student will win a scholarship, but if they follow the five steps by completing the FREE online Five-Step e-Course they can build a strong foundation to highly increase their chances of winning scholarships.

Always talk to your parents, guardians, spouses, and/or a responsible adult, and/or the experts such as college admissions personnel and high school counselors, if you have questions about any and all opportunities offered on Edudaris® or you are unsure of your chances of admission to a particular college, university, or school. You assume all risks regarding your use of these tools, Path to Scholarships® and furthermore understand that any decision to apply or not to apply to all and any particular offer, opportunity, scholarship, college, university, or school and the resulting consequences are your sole responsibility.

Outreach Youth Empowerment, LLC and Edudaris® does not warrant that any Edudaris® site will operate error-free or that its servers are free of computer viruses or other harmful mechanisms. If your use of Edudaris® site results in the need for serving or replacing equipment or data, Outreach Youth Empowerment, LLC and Edudaris® are not responsible for those costs. The Edudaris® sites and web site content are provided on an “AS IS” basis without any warranties of any kind. To the fullest extent permitted by law, Outreach Youth Empowerment, LLC and Edudaris® disclaims all warranties, whether expressed or implied, including warranty of merchantability, fitness for a particular purpose and non-infringement.

Damage Limitations to Outreach Youth Empowerment, LLC, Edudaris® , and Third Parties  In no event shall Outreach Youth Empowerment, LLC and Edudaris®, its affiliated entities, its suppliers, or any third parties mentioned on any Edudaris® site be liable for any damages whatsoever (including without limitation, incidental and consequential damages, lost profits, or damages resulting from lost data or business interruption) resulting from the use or inability to use any Edudaris® site and the web site content, whether based in contract, tort, or any other legal theory, and whether or not Outreach Youth Empowerment, LLC and Edudaris® is advised of the possibility of such damages. The aggregate liability for Outreach Youth Empowerment, LLC and Edudaris®, to you for all claims arising from the use of the Edudaris® or any Edudaris® site is limited to the sum of Five and 00/100 Dollars ($5.00).

Use of the Web Site is not a substitute for applying to colleges and universities Use of the Web Site is not an application to colleges and universities. The Web Site merely assists Users in evaluating alternative colleges and universities as part of the college application process. Students are encouraged to use Edudaris.com as a guide to assist them in determining which schools they should consider applying to.

5. No Resale or Unauthorized Commercial Use

You agree not to resell or assign your rights or obligations under these Terms of Use. You also agree not to make any unauthorized commercial use of any Edudaris® site.

6. Indemnity

You agree to defend, indemnify, and hold harmless Outreach Youth Empowerment, LLC , Edudaris®, and its members, officers, directors, employees and agents, from and against any claims, actions or demands, including, without limitation, reasonable legal and accounting fees, arising from or resulting to your use of any Edudaris® site or your breach of these Terms of Use. Edudaris® and Outreach Youth Empowerment, LLC shall provide notice to you promptly of any such claim, suit, or proceeding and shall assist you, at your expense, in defending any such claim, suit or proceeding.

7. General Terms of Use

Outreach Youth Empowerment, LLC and Edudaris® makes no claims that the web site or the web Site content may be lawfully viewed or accessed outside of the United States. If you access the Edudaris® from outside of the United States of America, you do so at your own risk and are responsible for compliance with the laws of your jurisdiction.

These Terms of Use are governed by the laws of the State of Florida, without respect to its conflict of laws principles. Jurisdiction for any claims arising under these Terms of Use or the use of the web site shall lie exclusively with the state or federal courts within Orlando, Florida and by use of the web site you submit to the jurisdiction of these courts. If any provision of these Terms of Use is found to be invalid by any court of competent jurisdiction, such invalid provision shall not affect the validity of the remaining provisions of these Terms of Use, which shall remain in full force and effect. No waiver of any compliance with these Terms of Use shall be deemed a further or continuing waiver of such term or any other term. Except as expressly provided in additional terms of use for areas of the web site, a particular "Legal Notice," or Software License or material on particular web pages, these Terms of Use constitute the entire agreement between you and Outreach Youth Empowerment, LLC and Edudaris® with respect to the use of web site. These Terms of Use may be amended at any time and from time to time, by a revised posting on this page. We do not undertake any obligation to otherwise notify you of such amendment.

Certain areas of Edudaris® and the other Edudaris® sites are subject to additional terms of use. By using such areas, or any part thereof, you agree to be bound by the additional terms of use applicable to such areas. Without limiting any of the other disclaimers of warranty set forth in these Terms of Use, Outreach Youth Empowerment, LLC and Edudaris® does not provide or make any representations, warranties or guarantees as to the quality or nature of any of the products or services purchased through the web site or any other Edudaris® site. Any such representation, warranty or guaranty would be furnished solely by the provider of the product or service, under the terms agreed to by the provider.
